Disclaimer for Wrap Plan Document/Wrap SPDs

The Employee Retirement Income Security Act (ERISA) requires every employer‐sponsored health and welfare plan to have and maintain a written Plan Document and Summary Plan Description (SPD) (or a combined Plan Document and SPD). As the sponsor of an ERISA plan, it is your obligation to have these documents in place. We are able to produce The Wrap Plan document/Wrap SPD to assist you, the sponsoring employer, with your obligations under ERISA.

By producing this document for you, we are not assuming any legal responsibilities under ERISA. It is still your obligation to maintain a properly‐adopted written Plan Document/SPD for your ERISA plan, and to provide this document to participants as required under ERISA. You are also responsible for updating this document on a timely basis when there is a change in plan design or legal requirements. We can help you with this process, but it is your obligation to maintain up‐to‐date documentation of your ERISA plan.

The document is intended to cover all topics currently required under ERISA for Plan Document and SPD. We will base the document on information that is specific to your benefit plans. Although we will make every effort to accurately reflect your Company’s information, the terms and provisions of benefits, and overall plan design, you must review the Plan Document/SPD for accuracy. It is solely the responsibility of the sponsoring employer to ensure that the terms of the Plan Document/SPD accurately reflect the terms of the plan. To avoid creating unintended liability, it is very important that your benefit plans are correctly described in this document and that your benefit communications to participants are Accurate.
